Privacy Policy and Personal Information Collection Statement

Vital Care Hong Kong Limited ("Vital Care") and its affiliates whose place of business are located in Hong Kong ("we", "us") are committed to complying with the Personal Data (Privacy) Ordinance, Chapter 486 of the laws of the Hong Kong (the “Ordinance"). Our privacy policy statement ("PPS") and personal information collection statement ("PICS") as set out herein (collectively known as "Statement" or "this Statement") explain the privacy policy and practice regarding how we use and protect any personal data that you provide. In this document, “Services” (as the context requires) refers to products or services provided to you by Vital Care, products and/or services purchased by you from Vital Care, notices or documents issued to customers, or actions requested to be taken by Vital Care. Please note that this Statement may be amended from time to time without prior notice. You are advised to check for the latest version on a regular basis.

This Statement has been translated into Chinese language. If there is any inconsistency or conflict between the English and Chinese versions of this Statement, the English version shall prevail.

The Statement as mentioned only apply to us and our affiliates. If you click on any hyperlink linking to another website, you will leave our websites for another location. We shall not be responsible for the privacy and security practices or the content of such websites and you should always check the privacy policy of all websites you click in.

1. Privacy Policy Statement

  1. Our Pledge 

    a. We are committed to safeguard the privacy of individuals with respect to your personal data. We assure that our policies and practices, in relation to the collection, use, retention, disclosure, transfer, security and access of your personal data comply with the requirements under the Ordinance, as well as the relevant code of practice and guidance issued by the Office of the Privacy Commissioner for Personal Data, Hong Kong. The meaning of the term "personal data" adopted in this Statement is defined in the Ordinance. 

    b. Where our operations are subject to privacy legislation other than that of Hong Kong (such as due to our carrying out of operational functions outside of Hong Kong), this Statement shall apply so far as it is consistent with such local legislation. 
  2. Collection of personal data

    a. At times, you may be required to provide your personal data including, but not limited to, your name, gender, date of birth, identity document number and/or its copy, telephone number, fax number, location, postal address and/or its proof, email address, credit card information, bank account number, health information etc. Refusal to provide such information may render us unable to handle any application or request you are making, or may deny your access to our websites, or may otherwise defeat the objectives of your intended use.

    b. If you are under the age of 18, consent from your parent or guardian is required before you provide us with any personal data.

    c. Information relating to your use of our Services or purchase of our products, including attending any promotional events, seminars and/ or meetings, may be automatically collected for our accurate reporting and administration of your request, application or participation.

    d. Some of our websites may disclose non-personally identifiable aggregate statistics relating to our visitors to affiliated companies, contractors and/ or advertisers. Some of our websites may collect aggregate information about our visitors, e.g. statistics on the number of visits. This type of data may include, but is not limited to, the browser type and version, operating system, IP address and/or domain name.

    e. Calls between you and our Customer Service may be recorded for the purposes of staff training, improvement of service quality and clarification of contractual issues.
  3. Use of cookies

    Like many other websites, we record your visit automatically through cookies, which are some small data structures sent to your computer to record your visit to our official website and to identify you during your future visits. You may refuse to accept these cookies by activating such setting on your browser. However, if you select the cookies refusal setting, you may be unable to fully experience certain features of our websites.

    We may also collect information regarding your IP address, browser type and settings, language preferences, geographic location, operating system, domain name, previously visited webpages, and the time spent browsing our website. The data collected will be used solely for maintaining and improving the operation of our website or for research purposes. We do not, and have no intention to, use visitors’ information for the purpose of identifying individuals.
  4. Accuracy of personal data 

    Your use of/application for our Services may be subject to verification of your personal details. If we regard results of such checking is unsatisfactory, we will not enter into an agreement with you. Under certain circumstances, data provided by you will be validated by using generally accepted practice. We may also require you to show the original documentation, such as personal identification document and/or proof of address, where applicable.
  5. Use of personal data collected

    Specific purposes for which your personal data may be used are set out in our "Personal Information Collection Statement" set out in Part 2 below (particularly those contained in Part 2.1 below).
  6. Data access and correction

    Under the Ordinance, you have the right to: 

    a. Check whether we hold any of your personal data;

    b. Access your personal data held by us;

    c. Request us to correct any inaccurate personal data held by us; and

    Ascertain our policies and practices established (from time to time) in relation to personal data and the types of personal data held by us. If you want to access and/or correct your personal data which you have given us via application form, internet or other means, or if you want to ascertain our policies and practices in relation to personal data and the kind of your personal data held by us, please contact our Data Protection Officer in writing and send your correspondence to Vital Care Hong Kong Limited, 2 Tai Fu Street, Tai Po Industrial Estate, Hong Kong. Please mark “Confidential Document” clearly on the envelope. In accordance with the Ordinance, we may charge you a reasonable fee for each personal data access. However, such fee will be waived if the data access is made for the purpose of correcting your personal data.
  7. Security of personal data

    We are committed to protecting the security of your personal data. We strive to ensure compliance by our staff with the strictest standards of security and confidentiality. We use various encryption techniques to transmit via the Internet your personal data, which can only be accessed by our authorized personnel. Given the operational nature of the Internet, we cannot guarantee that the transmission is fully secure. Please refer to our "Security Statement" in Part 3 below for details on the steps that we have taken to ensure that any personal data collected by us via our websites is safe and secure to avoid unauthorized interference by third parties. As effective as modern security practices are, no physical or electronic security system is entirely secured. We cannot guarantee the complete security of our database, nor can we guarantee that data you supply will not be intercepted while being transmitted to us over the Internet or otherwise. We have implemented internal guidelines to ensure as far as possible that your privacy is safeguarded at every level of our organization. We will continue considering to revise policies and implement additional security features as new technologies become available. Although we will do our best to protect your personal data, we cannot guarantee the security of your personal data transmitted to our website. Any transmission of personal data is at your own risk. Once we have received your personal data, we will use appropriate security measures to seek to prevent unauthorized access or disclosure.
  8. Record Retention and Access to Personal Data

    Physical records containing personal data are securely stored in locked areas when not in use. Access to such physical and/or computer records is strictly controlled and requires management approval for each access. Approvals for access to customers’ personal data are granted only on a "need to know" basis. Where we retain, use and/or transmit customers' personal data, we have put in place adequate measures to protect it from accidental and/or unauthorized disclosure, modifications, loss and/or destruction.
  9. Retention of personal data

    We will only retain the personal data for so long as necessary to fulfill the purposes for which it was collected and for the purposes of satisfying our legal, accounting or compliance-related requirements after which it will be destroyed without further notice to you.

    To determine the appropriate retention period, we will have regard to the amount, nature, sensitivity, the potential risk of harm from unauthorized use or disclosure of the personal data, the purposes for which we collect/process the personal data and the applicable legal requirements.
  10. On-line Services

    We may promote on-line stores or service providers operated by third party merchants on our website. If you want to use or order any Services or products from them, please note that once the information that you provided is transferred to the relevant merchant, it will be beyond our control and thus outside the scope of protection afforded by us.


2. Personal Information Collection Statement 

  1. As a customer, or a visitor or user of our website(s), it may be necessary for you to provide us with your personal data when you apply to us for or use the Services. If your personal data is incomplete or incorrect, we may not be able to provide or continue to provide the Services to you, or allow you to use the Services. We shall keep your personal data confidential at all times. Our policies and practices with respect to the collection, use, retention, disclosure, transfer, security and access of personal data will be in accordance with requirements under the Ordinance and this Statement. We may use and retain the personal data provided by you for the following purposes and for other purposes as shall be agreed between you and us or required by law from time to time:

    a. Processing of your application for or use of the Services (including but not limited to purchase of Adrien Gagnon products);

    b. Contract implementation and enforcement;

    c. Recruitment and human resource management including online job applications;

    d. To provide you with Adrien Gagnon Membership services;

    e. With your consent or indication of no objection, we will use your name, telephone number, email address, and month of birth to send you Adrien Gagnon communications, promotional information, and related publications, for the purpose of promoting Adrien Gagnon products;

    f. Subject to your consent or indication of no objection, we may use your personal data (including name, gender, telephone number, fax number, location, postal address, email address, month and year of birth, as well as the information on your health or other information about you) for the Services as set out in the relevant document which may be subject to change from time to time relating to us, our affiliated companies and business partners. We may dispatch to you the document, information or notice via telephone calls, e-mail, e-message, facsimile, direct mailings or other media whether now known or available in the future;

    g. Processing of any benefits for you arising out of the Services and carrying out market research to enhance service quality or experience;

    h. Providing you with our Services, including analysing, verifying and/or checking of your information in relation to the provision of the Services;

    i. Processing of any payment/delivering instructions, or other instructions requested by you;

    j. Facilitating the handling of your information/request in relation to the Services;

    k. Normal management, improvement, operation and maintenance of our website;

    l. Providing you with regular or ad hoc communications from us with details of our retail business and relevant benefits;

    m. Carrying out prize draws, games or competitions which you have entered;

    n. Carrying out data sorting and analysis to enable us to better understand your characteristics and buying behaviour and to provide other services better tailored to your needs, and to assist us in selecting retail goods or Services that are likely to be of interest to you;

    o. Investigation of complaints, suspected suspicious transactions, and research for service improvement;

    p. Enabling us to perform any obligations, or to comply with any requests stipulated by governmental or regulatory authorities;

    q. Enabling us in prevention of crime;

    r. Complying with the requirements to make disclosures under the requirements of any law; and

    s. Implementing any other purposes relating to the above.
  2. We may disclose and transfer (whether in Hong Kong or overseas) your personal data to the following parties to use, disclose, process or retain your personal data for the purposes mentioned above:

    a. our subsidiaries and other affiliates and any other members of the CK Life Sciences group (whether domiciled or operating in Hong Kong or abroad) that carry out functions that support us in fulfilling the purposes set out in this Statement;

    b. agents, contractors and other service providers authorised or engaged by Vital Care or its affiliate who are under a duty of confidentiality to Vital Care or its affiliate or other contractual terms to safeguard your personal data, and who provide administrative, data processing, research and marketing, distribution, sales, professional or other services to the company or its affiliate;

    c. Our business partners;

    d. Banks, financial institutions and credit providers;

    e. Debt collection agencies, credit reference agencies and security agencies;

    f. Domestic and overseas government and regulatory bodies, law enforcement agencies and courts or arbitration tribunals; and

    g. Our professional advisers. We may transfer personal data to a purchaser or transferee (or proposed purchaser or transferee) of any of Vital Care’s business or the business of a particular division or line of our business, or any such business of an affiliate (whether through a sale of assets or shares), including for the purposes of any due diligence exercise, subject in each case to our compliance with all applicable legal and regulatory obligations.

If at any time in the future you do not wish to receive information from us with respect to the products/Services mentioned above, or do not wish us to disclose, transfer or use your personal data for the aforesaid purposes, please send your request to our Data Protection Officer stated under “Enquiries” below.


3. Security Statement

While internet is not an inherently secure environment for communications, security of internet communications can be enhanced by the application of appropriate technology. However, internet security is not solely a technical issue, knowledge on security of personal and transaction data as well as general measure are equally important. "Hackers" could only attack a system through a "door". However, in most cases imprudent transmission and handling of sensitive data such as confidential documents, password, personal identifiers etc. would facilitate unauthorized access to such a "door" by "hackers". Hence, internet users should be cautious when handling such kind of sensitive documents and data.

In order to prudently preserve all personal data obtained from users of our websites, apart from firewalls and other sophisticated technical facilities, we also provide and maintain other stringent security measures so as to protect our system as well as the information and data retained therein from accidental or malicious destruction or damage.
